View Full Version : License Recalled?

Let me set the scene for y'all.
Back at the end of July, I got pulled over for going a bit too fast. A cop tracked me going 57 in a 35 mph zone (oops). He said that he could give me 5 points on my license but he chose to give me 3 points instead. He didn't bother to reduce the fine so I had to pay the full $179.50.
I've moved on since then. I don't drive nearly as fast when there's a possibility of getting pulled over. I put the ticket behind me. Until a few days ago. The DMV sent me a notice that due to my 3 point ticket, my license was going to be recalled as of September 19! Needless to say, I was upset.
In VT, we have a graduated license program. Basically, I have a "junior operators" license until I'm 18. They place restrictions ondriving passengers and crap like that. Nothing states that if you get ONE speeding ticket they can take away your license. The only thing in the laws that even hints at this is the fact that a junior operators license is a "provisional" license that is eligable to be recalled. I guess this means that the can recall it for any reason at any time.
I admit, speeding isn't the smartest thing to do. But I paid my ticket on time! Why should they punish me again?
I realize that this isn't the most serious problem in the world right now, but it's something I don't need to deal with right now.
I just needed to bitch. That is all. Oh, and we are going to try and request a hearing.
EDIT: Alright, here's why I got the ticket to begin with. I was sitting at a red light. It was 10:30 at night. A car pulls up next to me (to make a left). They stopped about six feet from the stop line, so this caught my attention. When the light changed, the car beside me didn't move. Unfortunately, I payed more attention to what they were doing in my rear view window than to how fast I was going. This wasn't in a neighborhood or anything even CLOSE to that. I was just passed a strip mall area and I got pulled over in front of some flag shop.
Edited by Diskeater on 09/09/02 11:13 PM.

57 in a 35
Sounds like you were speeding badly in a residential neigbourhood where you could hit a kid or somthing. I may sound like an ass, but im glad your license is recalled. I may sound like an ass, but it should be. If a little kid ran out infront of you, hes dead.
I actually heard complaining about a similar but serious incident like this before. Where i was working at, epople were complaining that thier friend was charged with manslaughter. They thought the penalty was harsh He guy drove drunk, got in an accident and killed his sister. So sad to bad, he belongs behind bars. He only got 2 years..
Im sorry. Be glad you only lost your license. Dont whine about it because it was your own damn fault. Harsh, i know, but thats life.

Wrong. This was actually around a shopping mall-type area. Not a house for miles.

I meant that now I only speed when I'm on the interstate, and even there I only go about 5-10 MPH over the posted limit.

Kill somebody with a bat or knife: 25-life
Kill somebody with an automobile: 2 years, max. (or, as it seems, kill my best friend with a car: nothing happens)
(oh boy, here comes the rant, NOT directed at anybody here)
You want to drink and drive asshole? Be my guest, it's your fucking life, why the fuck would you care about others you drunken shit. why don't you just get drunk and start shooting a gun around some people, maybe they'll die! Don't bitch when you get 2 fucking years for murder, just because your weapon was stupidity and not a gun. They should take away your liscense, driving isn't your God-damned right. And if you run from the scene where you kill, I'd like to personally kill you with a broken lightbulb, you piece of shit.

Are you going to tell me that you've never gone 5 mph over the speed limit? That's how fast I drive now (especially around kids and in town). I just don't think it's right for them to take away my license after I've paid my penalty.

There is nothing in the law that states I should lose my license on account of getting 3 points on my license. The cop never said anything about a possible recall. This is the same state which finally revoked the license of a convicted DWI felon after DOZENS of offences.

you broke the law. you pay the price. driving is a privilege..not a right.
i had 77 in a 55 in august of 2000...that's like 4 or 5 points. i paid my fine and never heard about it again...but apparently i didn't get the message.
i totalled the car in october on a deer...but apparently i didn't get the message.
i hit another deer with the new car. i got the message.
i drive 80+ on the deserted highway at 6 or 7am on a sunday morning...otherwise, i don't speed at all. it's stupid and it's not worth it.
i'm not sure whether my "incidents" influenced my mindset or i just grew up...but you need to do the same.

A. Fines are rarely ever the only penalty. A lot of times they make people take traffic school or revoke the license or put limitations on the license or other things. Since you are on a provisional license, you had to expect something beyond just a ticket.
B. It's good that you've learned to slow down, but it's better to learn not to let something take your focus off your surroundings and your speed, because I'm sure if you saw the cop, you wouldn't have gone that fast. The car that stopped 6 feet behind the line took your focus, which apparently caused you to not watch your speed too, although frankly, if something in my rear view mirror was taking my focus, it would cause me to drive slower rather than faster.
C. Swampy undoubtedly drives <= the speed limit 100% of the time. Trust me on that.
D. I admittedly have driven as much as 25 MPH over the speed limit. I am VERY careful about it though. If there is any chance of a cop seeing me go that fast, I don't, and if I can't drive safely while going that fast, I don't....simple as that. Just like in NFL...many penalties never get noticed because the players know when they can do it and get away with it....such as life.

I've had my share of speeding tickets. No accidents. Naysayers that wish to preach "my time will come", don't bother. Refer to part above about my
Some of you talk as if streets were created for pedestrians. Um.. we have sidewalks. And I don't know what backwoods places you guys live, but most the places I've been only have crosswalks at signals. So if some dumbass is smart enough to walk into the middle of the road and I hit him, I'm probably just doing my part to thin the heard.
People. we are talking bout regular streets here! not the walmart parking lot.

Hell yeah, I love speed when I know I won't get busted for it, had my monte carlo ss going up a 30 degree hill going 50mph and the 15 265 50 series *real wide* were still spinning, and thats a 30 mph zone, and I had a station wagon about 3 years ago and I was on interstate 93 and got it going over 130mph at 2 am, was with my uncle in his corvette and the speedometer goes to 160mph and he buried it, thought I was gonna piss my pants at that speed.

Yes. Zombie pedestrians. In which case, it doesn't matter because you have to cause them severe head trauma to die. I've seen plenty of Zombies get hit by vehicles and live to groan about it.

Give me a break - the guy deserved his license was taken away, plus it was likely in the paper work when he applied for his license. SO he can sue, and there is nothing communist about this. Hell, go read somthing on Marx before you even dare make such an ignorant statment.

Nope, nothing explicitly stated that having more than 3 points on my license would be grounds for a recall.

Are you sure?
I thought with the demerit system you license was able to be taken away any time. Im pretty sure what happen to you is when your ticket went into the computer, it was automatically flagged for how many demerit points you recieved and you lost it when the pencil pusher checked the amount you were speeding and recalled it.
