If you or anyone you know is going to law school and want to do some pro bono work for credit or a paper or something...I'd like the legality of emulation researched (including references to the DMCA).

1) YOU copying the ROM from a cartridge or CD that you legally purchased.
2) Obtaining the ROM that SOMEONE ELSE copied from the cartridge or CD that s/he legally purchased when:
2a) you own the original as well
2b) you do NOT own the original
3) Emulating a chipset
3a) Reverse engineering the chipset to emulate it
3b) Using leaked (and presumably illegal) documentation or SDKs to emulate it
3c) Using freely available documentation/SDKs
4) Distributing the ROM code for the music data (SPC/GYM/NSF)
5) Distributing data (a patch, not a program executable) which modifies and/or circumvents encryption on the ROM data (CPS2 XOR)
6) Distributing data (a patch, not a program executable) which modifies the ROM data itself (translation/hacks)

Obviously our friends at Nintendo, Sony, MS, et al read this site and board...so if you'd like to chime in, it's sam at zophar dot net.

Not going to law school and don't feel like digging up references to the USC right at the moment, but a bunch of this is just in the regular copyright stuff and the DMCA doesn't directly apply, just so you're aware.

I'm looking for a thorough and in-depth analysis of the copyright law, including the new stuff introduced by the DMCA.
