Well, this is an interesting situation. The main manager asked one of the shift managers (not as highly "ranked" as him) to work overtime. She said "I guess so" then he said: "Oh, but we can't pay you the overtime rate."

Now, right then and there, I would be like: "No way." Having the balls to say that is one thing, but just not doing that leads me to believe in some legality issues. Working more than 40 a week and being paid the flat pay rate instead of 1.5 * it has to be illegal, right?

So my final answer to this is: If you ain't giving me my 1.5, I'll give you 0. Fair deal, bub. That's basically what the lady manager said too.

Three things:

1) Read company policy. If you signed in and there is a clause where you are overtime exempt, you are SOL.

2) Call "commerce laws"(*) in your state. See what the local laws are concerning the matter.

3) If 1) and 2) Indicate a violation of company policy/commerce laws, REPORT, REPORT AND REPORT. To superior managers AND the state. Make it look professional and they will take it seriously.

(*)Need to clarify what this is. It's basically someone who works for the state in charge of watching for this kind of crap to happen. I didn't know it was called like that, but I guess working for unemployment office for the state, you learn things you didn't know :)
